Though it’s illegal to drive without insurance in the United States, more than 16% of Americans are uninsured. Getting into an accident with an uninsured driver may be rare, but it does happen. Here’s how you can handle an accident with an uninsured driver:
- Carry Uninsured Motorist Coverage
It never hurts to be prepared. One of the best ways to avoid getting burned by an uninsured driver is to ask your insurance company about its uninsured motorist coverage. Adding this protection to your policy may cost extra, but it could be a lifesaver.
- Get the Other Driver’s Information
After an accident occurs, you should still get the other driver’s information, even if that driver doesn’t have insurance. Ask for his or her name and contact information, just in case your insurance company has any questions about the incident.
- Check Your Insurance Policy
Though it may be tempting to file a personal injury claim against an uninsured driver, keep in mind that his or her main reason for being uninsured is probably a lack of funds. When it comes to reimbursement for damages, you’re best off looking to your own insurance company. If you don’t have uninsured motorist coverage, then see if your policy includes a similar clause.
Though your insurance company may claim to have your best interests at heart, you’ll find that they don’t part with large sums of money easily. If you feel as though your insurance company is short changing you, then call an experienced lawyer to help review your policy and get the compensation you need.
If you’ve recently been hit by an uninsured driver and are now wrangling with your insurance company to collect for damages, then contact the Santilli Law Group. Since pedestrians and motorists frequently need to use the road at the same time, it’s important that their interactions are managed with a set of laws. While you may expect most of these laws to be aimed at motorists, given the size and power of their vehicles, pedestrians aren’t free from responsibility. Here’s a quick look at laws regarding pedestrians.
- Pedestrians Must Use Crosswalks
Crosswalks can be found in every city in the United States and are designed to give pedestrians a place to safely cross the street. Though most cities have many crosswalks, pedestrians don’t always use them, opting instead to jaywalk, or cross the street elsewhere. Though jaywalking may be more convenient for pedestrians, the law requires that they use crosswalks for their own safety and the safety of others.
- Drivers Must Stop at All Crosswalks
Last year, Governor Quinn approved an Illinois state law that requires all vehicles to come to a complete stop whenever they come to a crosswalk, whether a pedestrian is present or not. This is an excellent way to prevent thousands of Illinois pedestrians from getting hit and terribly injured.
- Drivers Must Yield to Pedestrians at All Times
Though it’s illegal for pedestrians to jaywalk, drivers must still yield to pedestrians at all times. Under no circumstances can a motorist legally hit a jaywalking pedestrian. Though this may seem as if it gives pedestrians free rein over the road, motorists should take solace in the fact that jaywalking pedestrians are fined when caught.
