    Injured on the Job? What You Need to Know

    Who qualifies for workers’ compensation?

    The first requirement under workers’ compensation law is that you must have suffered your personal injury while on the job.  Worker’s compensation law covers accidents while on the job, as well as more subtle injuries, such as chronic back pain, neck pain, carpal tunnel, and exposure to toxic chemicals.  Certain behaviors can breach your eligibility, such as intoxication and reckless behavior.

    What benefits do you receive?

    If you are able to prove your workers’ compensation claim, then you will receive unlimited access to medical care for your work injury.  Furthermore, if your doctor says that you are unable to return to work, then you will receive 2/3 compensation for this time, as long as the time is longer than 3 days.

    How can I receive these benefits?

    You should report a work injury as soon as it occurs.  This will prevent your employer from saying it did not happen on the job.  In Illinois, you must seek care and file for workers’ compensation within 3 years of the injury.  Your employer should be willing to pay your workers’ compensation claim.  However, there are often disagreements and if your employer is unwilling to pay, then you should seek the help of a lawyer.
